Bad lawyering

Man agrees to plea deal; his own lawyer failed to notice that the
maximum sentence for the crime was 5 years, not the much longer period
noted in the agreement. The judge didn't notice.

After serving 8 years with many more years remaining, it was finally
noticed that he was serving more than the sentence in law.

appellate court won't let him out of prison as he had to raise the issue
without 3 years.
