| Palmer said Tata had an obligation to pay higher fees associated
| with securing H-1B visas, which Tata avoided by fraudulently
| securing L-1A visas and B-1 visas instead.

| But Tata's obligation "to pay the H-1B visa fee was contingent upon
| it applying for an H-1B visa. Applying for L-1A and B-1 visas in
| their place did not trigger any obligation to pay an H-1B visa fee
| because Tata did not apply for an H-1B visa for those positions,"
| the court said.
