she'll get a national abortion law passed that resets everything back
to the
Roe/Wade status quo.
Except that won't work and she almost certainly knows it.
When the Court overturned Roe, it ruled that the power to regulate
abortion is
found nowhere in the Constitution and that, per the 10th Amendment,
any power
not specifically granted to the federal government belongs to the
state and
local governments.
So it didn't just find that the Judicial Branch had no jurisdiction over
abortion. It found that the ENTIRE federal government has no
jurisdiction over
or power to regulate abortion. So even if Kammie gets Congress to pass a
national abortion law, it will be challenged instantly and the Court
will just
apply the same test it applied in Dobbs and reach the same result:
Kammie's
law will be overturned as unconstitutional.
expand the Supreme Court to the point where it is overwhelmingly
leftist; then they won't rule the way you're predicting and will find a
penumbra somewhere that implies that the Founders meant abortions to be
a federal matter.
Or she's just blowing smoke up everyone's ass.
I wonder if you've ever written the words "overwhelmingly rightist"....
Meanwhile, fyi, the 5th, 9th, and 14th Amendments have all been cited as
implying abortion rights
As you correctly observe, it's just a matter of finding another "penumbra" to
evade the Right's latest one
...and it'll stay that way unless and until people give up on enforcing
their beliefs onto others.
