Yeah, you can put anything in the pleadings of a lawsuit but that seems
absurd.

Does no one take responsibility for their own actions any more? Is
absolutely EVERYTHING someone else's fault and never your own?

There is a law in Colorado that precludes such lawsuits. I don't know
that I agree that someone attending a game takes on the entire
responsibility of being struck with a foul ball but that's what the
adhesion contract likely says. He's desperate to get around state law,
so he came up with something stupid to argue.

I'm reminded of a story I heard many years ago about a young man whose
parents were attractive, smart, and successful. He sued them because he
was ugly, stupid, and a loser. The judge laughed him out of court.

I wonder if he attempted to try to live his own life, he might have
stopped being a loser.
