Defendant misses court date. Judge refuses to believe attorney that
client wasn't in contempt by being in the hospital emergency department.
Now, Steve Lehto comments that a judge wouldn't necessarily accept the
attorney's word and might schedule a show cause hearing requiring the
defendant to document why it was necessary to miss court.
Instead, the judge ordered a bailiff to arrest the defendant in hospital
but the bailiff explained he could not leave court. The judge, after his
clerk figured out where the defendant was, drove to hospital to make the
arrest herself.
The defense attorney came along in her vehicle. The state did not. That
makes the ride unethical ex parte communication. The defense attorney
eventually talked her out of making the arrest so she turned the vehicle
around.
In her disciplinary hearing, she didn't dispute the facts.
