Content
    A total of 93 tests were conducted in daytime conditions to evaluate
the effect on the Time to Collision (TTC), emergency braking, and
avoidance rates of the Forward Collision Warning (FCW) and Automatic
Emergency Braking (AEB) provided by a 2022 Tesla Model 3 against a
4ActivePA adult static pedestrian target. Variables that were evaluated
included the vehicle speed on approach, pedestrian offsets, pedestrian
clothing, and user-selected FCW settings. As a part of the Tesla’s
Collision Avoidance AssistTM, these user-selected FCW settings change
the timing of the issuance of the visual and/or audible warning
provided. This testing evaluated the Tesla at speeds of 25 and 35 miles
per hour (mph) versus a stationary pedestrian target in early, medium,
and late FCW settings. Testing was also conducted with a 50% pedestrian
offset and 75% offset conditions relative to the right side of the
Tesla. The pedestrian target was clothed with and without a reflective
safety vest to account for different conspicuity during the testing. The
TTC at FCW and AEB, emergency braking deceleration and the avoidance
rates were compared between different settings and test parameters. The
test data was also compared against the IIHS pedestrian tests at
different speeds and scenarios.

The agency is asking if other similar FSD crashes have occurred in
reduced roadway visibility conditions, and if Tesla has updated or
modified the FSD system in a way that may affect it in such conditions.
NHTSA said the "review will assess the timing, purpose, and capabilities
of any such updates, as well as Tesla’s assessment of their safety
impact," the agency said.
Tesla's FSD technology has been in development for years and aims for
high automation, where its vehicle can handle most driving tasks without
human intervention.
Tesla in December recalled more than two million U.S. vehicles to
install new safeguards in its Autopilot advanced driver-assistance
system. NHTSA is still probing whether that recall is adequate to
address concerns drivers are not paying attention.
Tesla disclosed in October 2023 that the U.S. Justice Department issued
subpoenas related to its FSD and Autopilot systems. Reuters reported in
October 2022 that Tesla was under criminal investigation.
There have been at least two fatal accidents involving the FSD
technology, including an incident in April in which a Tesla Model S car
was in FSD mode when it hit and killed a 28-year-old motorcyclist in the
Seattle area.
Tesla's "camera-only" approach to partially and fully autonomous driving
systems, some industry experts have said, could cause issues in
low-visibility conditions as the vehicles do not have a set of back-up
sensors.
"Weather conditions can impact the camera's ability to see things and I
think the regulatory environment will certainly weigh in on this," said
Jeff Schuster, vice president at GlobalData.
"That could be one of the major roadblocks in what I would call a
near-term launch of this technology and these products," he said of
Tesla's robotaxis.
Tesla's rivals that operate robotaxis rely on expensive sensors such as
lidar and radar to detect driving environments.
