Not that you know the difference but, in both cases it could be
stated that the observation (life) is consistent with the
hypothesis.

"consistent with" is different from "empirical evidence"  Learn the
difference. 

And THAT really is a fairly decent definition of
evidence:  "An observation or measurement that is consistent with
a hypothesis."

Goal-post shift alert:  the issue here is *empirical* evidence. Here's
a clue for you: it's not about empires.
